Course Title: Law of Contract and Tort

Course Code: LAW 102 (New Course Code: LAW 502)

Group A: Law of Contract

1. Definition of Contract, Agreement. Kinds and Elements of a Valid Contract, Differences among Various Types of Contracts.

2. Offer: Definition and Kinds of Offer, Features of Offer, Communication of Offer, Invitation to Treat, Revocation of Offer.

3. Acceptance: Rules regarding Acceptance, When Acceptance Is Complete, Revocation of Acceptance.

4. Consideration: Rules regarding Consideration, Kinds of Consideration, Modes of Consideration, Exceptions to the Rule of Consideration, Unlawful Consideration.

5. Capacity to Contract: Capacity to Enter Into a Contract, Age of Majority, Definition of Minor. Rules regarding a Minor’s Contract, Contract with a Person of Unsound Mind and Legally Disqualified Persons. Corporation or Foreign Sovereign; Burden of Proof, Professional Incapacity to enter into a Contract.

6. Free Consent: Definition of Free Consent, Coercion. Undue Influence, Fraud, Misrepresentation and Mistake; Agreements of Impossible Acts, Unlawful Acts or Agreements against Public Policy.

7. Performance and Discharge of Contract: Rules regarding Performance and Discharge, Types of Discharge of Contract, Supervening Impossibility, Exceptions to and Consequences of Supervening Impossibility, Frustration of a Contract.

8. Remedies for Breach of Contract: Types of Breach of Contract, Types of Remedies, Rules regarding Remedies for Breach of Contract.

9. Contract of Bailment: Definition, Features of Bailment, Rights and Duties of Bailor and Bailee, Rights and Obligations of a Finder of Lost Goods.

10. Agency: Definition and Kinds of Agency, Creation of Agency, Ratification, Rights and Duties of an Agent, Principal's Rights and Duties against the Agent, Termination of Agency and Its Effects.

Group B: Law of Tort

1. Definition, Kinds, Aims and Functions of law of Tort.

2. Elementary Ideas: Intention, Motive, Mens Rea, Actus Reas, Injuria Sine Damnum, Damnum Sine Injuria.

3. Tortuous Liability: Nature and Types of Tortuous Liability, Legal Consequences of Vicarious and Strict Liability, Scienter Rule, General Defenses and Different Remedies against Tortuous Liability.

4. Trespass to Person, Goods and Land: Assault, Battery and False Imprisonment; Their Definitions. Kinds and Legal Consequences. Dispossession.

5. Specific Torts: Elements of and Rules regarding Negligence, Nuisance, Defamation, Intimidation, Deceit, Wrongful Confinement, Conspiracy, Injurious Falsehood and Malicious Prosecution.

6. Injuries to Servitude: Conversion and Other Injuries to Chattels. Goods and Persons.

7. Immunities and Extemptions.

N.B: From Group A, there will be five questions out of which three questions are to be answered (3 x 20 = 60). From Group B, there will be four questions out of which two questions are to be answered (2 x 20 = 60). There may be different parts of a single question indicating proper division of marks.
